Terms of Service

Effective date: August 22, 2026

These Terms and Conditions ("Terms") govern your use of the FotoCraft mobile application and related services (collectively, the "Service"). FotoCraft is an independent app developed and operated by an individual developer (referred to in these Terms as "FotoCraft," "we," "us," or "our"). By downloading, accessing, or using FotoCraft, you agree to these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

• You must be at least 13 years old to use the Service.
• If you are under the age of majority in your jurisdiction, you must use the Service with permission from a parent or legal guardian.

2. License to Use the App

• We grant you a limited, non-exclusive, non-transferable, revocable license to use FotoCraft for personal, non-commercial use.
• You may not copy, distribute, modify, reverse engineer, or create derivative works from the app except as permitted by law.

3. User Content and Photos

• You retain ownership of photos you capture or upload.
• You grant us and our service providers permission to process your photos as needed to provide analysis and app functionality.
• You are responsible for ensuring you have the rights and permissions for any content you submit.
• Discover community feed: You may optionally share a photo to the public Discover feed, where it becomes visible to other FotoCraft users. Sharing is voluntary and requires your affirmative action each time. Shared photos are screened by automated moderation before appearing and may be rejected or removed.
• By sharing to Discover, you grant FotoCraft a worldwide, royalty-free, non-exclusive license to host, store, display, and moderate the photo within the Service for as long as it remains in the feed.
• You may remove a photo you have shared to Discover at any time, which also deletes the stored image files from our servers. We may also remove content that violates these Terms, is reported, or is deemed inappropriate, with or without notice.
• Shared photos remain in the Discover feed for a limited period (approximately 14 days) and are then automatically removed from display; cached copies may persist briefly thereafter.
• If you believe a photo in Discover infringes your rights or otherwise violates these Terms, you may report it in the app or contact support@fotocraft.pro. We will review reports and remove content where appropriate.

4. AI Analysis and Educational Use

• FotoCraft provides educational feedback and suggestions about photography composition and technique.
• AI-generated feedback may be incomplete, inaccurate, or unsuitable for a specific context.
• The Service is provided for learning and informational purposes and does not guarantee photographic outcomes.

5. Subscriptions and Billing

• Certain features require a paid subscription ("Premium"), offered as weekly, monthly, or yearly auto-renewing plans, in some cases with a free trial.
• If you start a free trial, the trial converts to a paid subscription unless you cancel at least 24 hours before the trial period ends. The exact trial length, price, and renewal terms are shown in the App Store payment sheet before you confirm the purchase.
• Subscriptions are billed through your Apple ID account and renew automatically unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in Apple account settings.
• We do not control App Store billing systems and do not issue refunds directly where Apple policy applies.

6. Free Tier and Usage Limits

• Free users may be subject to daily analysis limits or feature restrictions.
• Limits, features, and pricing may change over time.

7. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or abusive activity.
• Post or share content that is explicit, sexual, violent, hateful, harassing, or otherwise objectionable.
• Upload content that violates intellectual property, privacy, or other rights.
• Interfere with, disrupt, or attempt unauthorized access to systems or networks.
• Use automated methods to scrape, overload, or misuse the Service.

8. Intellectual Property

• The app, brand, curriculum, design assets, code, and related materials are owned by FotoCraft or its licensors and are protected by applicable intellectual property laws.
• Except for rights explicitly granted in these Terms, all rights are reserved.

9. Third-Party Services

The Service may rely on third-party platforms and providers, including:

• Apple StoreKit for subscription management
• OpenAI for AI-powered photo analysis and moderation of photos shared to Discover
• Google (Firebase Crashlytics) for crash reporting and diagnostics
• FotoCraft backend services for analysis, daily tips, and the Discover feed (hosted on Vercel, using Upstash Redis and Vercel Blob storage)
• Apple Vision for on-device analysis

Your use of third-party services may also be subject to those providers' terms and policies.

10. Termination

• We may suspend or terminate access to the Service if you violate these Terms or misuse the Service.
• You may stop using the Service at any time by uninstalling the app.

11. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, FotoCraft and its licensors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service.

FotoCraft's total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid for a subscription in the twelve months preceding the claim, or (b) USD 10.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, liability is limited to the maximum extent permitted by law. Nothing in these Terms affects statutory consumer rights you may have under the mandatory laws of your country of residence.

13. Indemnification

You agree to indemnify and hold harmless FotoCraft and its licensors from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from content you share, your misuse of the Service, or your violation of these Terms.

14. Changes to the Service and Terms

• We may update, modify, or discontinue parts of the Service at any time.
• We may revise these Terms from time to time. We will indicate changes by updating the effective date shown on this page. Continued use after updates means you accept the revised Terms.

15. Governing Law

These Terms are governed by the laws of India, and any disputes arising out of or relating to the Service or these Terms are subject to the exclusive jurisdiction of the competent courts of India. If mandatory consumer protection law in your country of residence gives you different rights or venue, those rights remain unaffected to the extent required by law.

16. General

• If any provision of these Terms is held unenforceable, the remainder stays in effect.
• Our failure to enforce any right or provision is not a waiver of that right.
• You may not assign these Terms. We may assign them together with a transfer of the app or Service to another developer.
• These Terms, together with the Privacy Policy, form the entire agreement between you and FotoCraft regarding the Service.
