Terms of Service

Effective date: February 9, 2026

These Terms and Conditions ("Terms") govern your use of the FotoCraft mobile application and related services (collectively, the "Service"). By downloading, accessing, or using FotoCraft, you agree to these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility

• You must be at least 13 years old to use the Service.
• If you are under the age of majority in your jurisdiction, you must use the Service with permission from a parent or legal guardian.

2. License to Use the App

• We grant you a limited, non-exclusive, non-transferable, revocable license to use FotoCraft for personal, non-commercial use.
• You may not copy, distribute, modify, reverse engineer, or create derivative works from the app except as permitted by law.

3. User Content and Photos

• You retain ownership of photos you capture or upload.
• You grant us and our service providers permission to process your photos as needed to provide analysis and app functionality.
• You are responsible for ensuring you have the rights and permissions for any content you submit.

4. AI Analysis and Educational Use

• FotoCraft provides educational feedback and suggestions about photography composition and technique.
• AI-generated feedback may be incomplete, inaccurate, or unsuitable for a specific context.
• The Service is provided for learning and informational purposes and does not guarantee photographic outcomes.

5. Subscriptions and Billing

• Certain features require a paid subscription ("Premium").
• Subscriptions are billed through your Apple ID account and renew automatically unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel subscriptions in Apple account settings.
• We do not control App Store billing systems and do not issue refunds directly where Apple policy applies.

6. Free Tier and Usage Limits

• Free users may be subject to daily analysis limits or feature restrictions.
• Limits, features, and pricing may change over time.

7. Advertisements

• Free users may see advertisements if ads are enabled.
• Premium subscribers receive an ad-free experience for eligible placements.

8. Acceptable Use

You agree not to:

• Use the Service for unlawful, harmful, or abusive activity.
• Upload content that violates intellectual property, privacy, or other rights.
• Interfere with, disrupt, or attempt unauthorized access to systems or networks.
• Use automated methods to scrape, overload, or misuse the Service.

9. Intellectual Property

• The app, brand, curriculum, design assets, code, and related materials are owned by FotoCraft or its licensors and are protected by applicable intellectual property laws.
• Except for rights explicitly granted in these Terms, all rights are reserved.

10. Third-Party Services

The Service may rely on third-party platforms and providers, including:

• Apple StoreKit for subscription management
• OpenAI API for AI analysis and daily tips
• Apple Vision for on-device analysis
• Google AdMob for ads (if enabled)

Your use of third-party services may also be subject to those providers' terms and policies.

11. Termination

• We may suspend or terminate access to the Service if you violate these Terms or misuse the Service.
• You may stop using the Service at any time by uninstalling the app.

12. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, FotoCraft and its affiliates, officers, employees, and licensors are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Service.

14. Indemnification

You agree to indemnify and hold harmless FotoCraft and its affiliates from claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or violation of these Terms.

15. Changes to the Service and Terms

• We may update, modify, or discontinue parts of the Service at any time.
• We may revise these Terms from time to time. Continued use after updates means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of your local jurisdiction unless otherwise required by applicable consumer protection law.
